These Terms of Service (“Terms”) govern your access to and use of the website located at www.goodboyssocialclub.com, and any related content, products, and services (collectively, the “Site” or “Services”) offered by Good Boys Social Club (“GBSC,” “we,” “us,” or “our”). By accessing the Site, placing an order, or otherwise using the Services, you (“you” or “Customer”) agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or Services. These Terms are the only terms of service that apply to the Site and supersede any prior version posted anywhere on the Site.

1. Acceptance of Terms

By using the Site, you represent that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By using the Site, you represent and warrant that you meet this requirement. If you are under the age of majority, you may use the Site only with the involvement and consent of a parent or legal guardian.

3. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, offerings, or for legal or regulatory reasons. The “Effective Date” above reflects the date of the most recent revision. Continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

4. Products, Pricing & Availability

We make reasonable efforts to display our apparel and merchandise, along with accurate descriptions, images, and pricing. However, we do not warrant that product descriptions, colors, images, or other content on the Site are accurate, complete, reliable, current, or error-free.

All prices are listed in U.S. Dollars and are subject to change without notice. We reserve the right, at any time, to modify, discontinue, or limit the quantity of any product without liability to you. In the event a product is listed at an incorrect price due to a typographical, pricing, or technical error, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed.

5. Orders & Payment

When you place an order, you are making an offer to purchase the selected product(s) subject to these Terms. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or illegal activity, or errors in product or pricing information.

Payment must be made in full at the time of purchase through the payment methods made available on the Site. You represent and warrant that any payment information you provide is accurate and that you are authorized to use the payment method submitted. Sales tax will be applied where required by law.

6. Shipping & Delivery

Shipping timeframes and costs are provided at checkout and are estimates only; we are not responsible for carrier delays outside our control. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. You are responsible for providing accurate shipping information — we are not liable for orders delayed or misdelivered due to incorrect address information provided by you. Our Shipping Policy, available on the Site, is incorporated into these Terms.

7. Returns, Exchanges & Refunds

We want you to love your GBSC gear. Eligible items may be returned within thirty (30) days of delivery, provided they are unworn, unwashed, and in their original condition. Gift cards and items clearly marked “final sale” at the time of purchase are not eligible for return or refund unless required by law. To start a return, email hello@goodboyssocialclub.com with your order number and we will provide return instructions. You are responsible for return shipping costs; we recommend a tracked shipping method, as we are not responsible for returns lost in transit. Original shipping charges are non-refundable. Refunds are issued to the original payment method once the returned item is received and inspected, typically within 5–7 business days of receipt. Our Refund Policy, available on the Site, is incorporated into these Terms; if there is any conflict between this Section and the Refund Policy, the Refund Policy controls.

8. Account Registration

You may be able to create an account to track orders and manage preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@goodboyssocialclub.com of any unauthorized use of your account.

9. Intellectual Property

All content on the Site — including the GBSC name, logo, graphics, designs, product artwork, photography, and text (collectively, the “Content”) — is owned by or licensed to Good Boys Social Club and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written consent.

10. User Conduct

When using the Site, you agree not to:

• Violate any applicable law, regulation, or third-party right;
• Use the Site for any fraudulent or unauthorized commercial purpose;
• Interfere with or disrupt the security or performance of the Site;
• Attempt to gain unauthorized access to any portion of the Site or its systems;
• Upload or transmit viruses, malware, or other harmful code;
• Scrape, harvest, or collect information about other users without consent.

We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.

11. User-Generated Content

If you submit reviews, photos, comments, or tag us on social media (“User Content”), you grant Good Boys Social Club a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that User Content in connection with marketing and promoting the brand. You represent that you own or have the rights to any User Content you submit.

12. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by GBSC. We are not responsible for the content, privacy practices, or policies of any third-party sites. Your use of third-party sites is at your own risk.

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOOD BOYS SOCIAL CLUB AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Good Boys Social Club and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.

16. Dispute Resolution: Binding Arbitration & Class Action Waiver

Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased (a “Dispute”) shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and shall take place in, or be conducted by phone or in writing from, the county in which you reside or another mutually agreed location. The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

CLASS ACTION WAIVER: You and Good Boys Social Club agree that any Dispute shall be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing hello@goodboyssocialclub.com with your name and a clear statement that you wish to opt out of arbitration.

17. Governing Law

These Terms and any Dispute not subject to arbitration shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

18. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

19. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Good Boys Social Club regarding the Site and supersede any prior agreements or prior versions of terms posted on the Site.

20. Mobile / SMS Messaging

If you opt in to our text messaging program, you agree to receive recurring automated marketing text messages (such as new drops, restocks, events, and offers) from Good Boys Social Club at the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can get help by replying HELP or emailing hello@goodboyssocialclub.com. We do not sell or share your mobile opt-in information or phone number with third parties or affiliates for their own marketing purposes. Carriers are not liable for delayed or undelivered messages.
